01Acceptance of terms
By creating an account, accessing, or using Benehub (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you are agreeing to these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you may not use the Service.
The Service is operated by Benehub ("we", "us", or "our"). These Terms form a legally binding agreement between you and Benehub.
02Description of service
Benehub is a customer relationship management ("CRM") platform built on the GoHighLevel infrastructure and designed for licensed life and health insurance agents. The Service includes contact management, unified messaging (SMS, email, voice), workflow automation, calendars, an AI appointment-setting assistant, reporting, and access to our Lead & Ad Manager Program.
The Service is provided "as is" and "as available." We may add, modify, or remove features at any time at our discretion.
03Accounts and eligibility
To use the Service you must (a) be at least 18 years old, (b) be a licensed insurance agent or otherwise legally authorized to engage in the activities for which you intend to use the Service, and (c) provide accurate and complete account information.
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use.
You may not (i) share your account with others, (ii) use the Service on behalf of any person whose account has been suspended or terminated, or (iii) create multiple accounts to circumvent any limitations or fees.
04Subscription, billing, and renewals
Benehub is offered on a subscription basis. Current plans are:
- Monthly plan — $97 USD per month, billed monthly.
- Annual plan — $989 USD per year, billed annually as a single payment.
Subscriptions automatically renew at the end of each billing period at the then-current rate using the payment method on file unless you cancel before the renewal date in accordance with Section 5.
By subscribing, you authorize Benehub and our payment processor (Stripe) to charge your payment method for the subscription fee, applicable taxes, and any usage-based charges (see Section 6) on a recurring basis until you cancel.
If a payment fails, we may suspend or terminate your access to the Service. You remain responsible for any unpaid amounts.
05Cancellation and refunds
The short version
You can cancel any time. Cancellation must be submitted at least 24 hours before your scheduled renewal date to prevent the next charge. We do not issue refunds for subscription fees once charged, including for partial billing periods or unused time.
How to cancel
You may cancel your subscription at any time by (a) using the cancellation option inside your Benehub account, or (b) emailing crmsupport@benehub.com from the email address on file. Cancellation takes effect at the end of the current billing period — you retain access until that date.
The 24-hour rule
To prevent your next billing cycle from being charged, your cancellation request must be received at least 24 hours before your scheduled subscription renewal date. Cancellation requests submitted less than 24 hours before the renewal date may not be processed in time to stop the next charge. In that case, the cancellation will apply to the following billing cycle, and the most recent charge will not be refunded.
No refunds policy
All subscription fees are non-refundable. Specifically:
- We do not issue refunds for monthly subscription fees, partial months, or unused portions of a monthly billing period.
- Annual subscriptions are non-refundable in full or in part once the annual fee has been charged. If you cancel an annual subscription, your access continues through the end of the prepaid annual term.
- We do not issue refunds for usage-based charges (SMS, calls, email — see Section 6) that have been incurred.
- We do not issue refunds because of unused features, features you did not implement, your decision not to use the Service, or because of dissatisfaction with the Service after the subscription has begun.
Exceptions at our discretion
In rare circumstances — for example, a duplicate accidental charge, a verifiable billing error on our part, or a documented Service outage attributable to Benehub — we may issue a refund or credit at our sole discretion. Such exceptions do not modify the no-refund policy or create any future obligation.
06Usage-based charges
In addition to the subscription fee, the Service incurs pay-as-you-go usage charges for outbound and inbound communications. Current rates (subject to change with notice):
- SMS: $0.0095 per segment (a segment is approximately 160 characters of plain text). Adding images, emojis, or non-GSM characters may increase the per-segment cost.
- Outbound calls: $0.0168 per minute.
- Inbound calls: $0.010 per minute.
- Email: $0.0025 per email.
Usage charges are billed against a prepaid usage credit on your account. You can add credit at any time. Unused credit is non-refundable upon cancellation.
These rates reflect carrier and provider wholesale costs and may be adjusted if our underlying providers change their rates. We will notify you of material rate changes.
07Acceptable use
You agree not to use the Service to:
- Send unsolicited messages, spam, or any communication that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state telemarketing laws, or any other applicable law.
- Send messages to any recipient who has not provided proper prior express consent under applicable law.
- Send messages to recipients who have opted out, revoked consent, or are on a Do-Not-Call list to which you are subject.
- Engage in deceptive, fraudulent, or misleading practices, including misrepresenting your identity, your affiliation, or the products or services you offer.
- Distribute malware, attempt to interfere with the Service, or attempt to gain unauthorized access to any account or system.
- Resell, sublicense, or otherwise commercially redistribute the Service without our prior written consent.
- Use the Service to compete directly with Benehub or to build a competing product.
You are solely responsible for the content of all messages sent through the Service and for compliance with all laws applicable to those communications. We may suspend or terminate your access immediately for violations of this section.
08Communications & compliance
The Service includes tools that send SMS, voice, and email messages. You are responsible for:
- Obtaining and maintaining proper consent from your recipients in compliance with the TCPA, CAN-SPAM, state laws, and any other applicable laws or regulations.
- Honoring opt-out, unsubscribe, and STOP requests promptly.
- Complying with carrier requirements for SMS messaging, including 10DLC registration where required. While Benehub assists with phone number registration as part of onboarding, you are responsible for accurately representing your business and use case during registration.
- All licensing requirements applicable to your insurance practice in the jurisdictions where you operate.
Benehub is not a law firm and provides no legal advice. You are responsible for consulting your own legal counsel regarding your compliance obligations.
09Customer data
You retain ownership of all data you input into the Service, including contact records, conversations, and notes ("Customer Data"). You grant Benehub a limited license to host, process, and transmit Customer Data solely for the purpose of providing the Service to you.
You can export Customer Data to CSV at any time from inside your account. Upon cancellation, you have 30 days from the end of your final billing period to export Customer Data. After 30 days, Customer Data may be deleted from active systems, subject to reasonable backup retention.
You are responsible for the legality, accuracy, and quality of Customer Data, and for ensuring you have the right to provide it to Benehub for processing.
Our handling of personal information is described in our Privacy Policy.
10Third-party services
The Service is built on the GoHighLevel platform and integrates with third-party providers including Stripe (payments), Twilio (telephony and SMS), Mailgun (email delivery), and others. Your use of the Service is subject to the terms of those providers as they apply.
We are not responsible for the practices, policies, or actions of third-party services. Service interruptions or issues caused by third-party providers do not entitle you to a refund or credit.
11Service availability
We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, upstream provider outages, or events beyond our control. Scheduled maintenance and unscheduled downtime do not entitle you to a credit or refund.
12Intellectual property
The Service, including its software, design, content, trademarks, and logos, is owned by Benehub or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No rights are granted to you other than as expressly set forth here.
Any feedback or suggestions you provide regarding the Service may be used by Benehub without obligation to you.
13Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
BENEHUB DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED FROM BENEHUB CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
14Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENEHUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
BENEHUB'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO BENEHUB IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15Indemnification
You agree to indemnify, defend, and hold harmless Benehub and its officers, directors, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) the content of any communication you send through the Service.
16Termination by Benehub
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or for other reasons in our discretion. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will survive.
17Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Utah, and you consent to the exclusive jurisdiction and venue of those courts.
18Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service prior to the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
